Constitutional Court Upholds Law Supporting Hydroelectric Projects
The Constitutional Court has reinforced the progress of renewable energy in Romania by upholding a key law that allows the continuation and completion of hydroelectric plants initiated before 2007. This decision is a significant step towards enhancing the country's energy infrastructure while balancing environmental considerations.
On Wednesday, the court rejected an objection of unconstitutionality raised by the President of Romania, deeming it unfounded. The ruling was made with a majority of votes and confirmed the constitutionality of the law concerning protected natural areas and environmental impact assessments.
The law in question modifies Article 5 paragraph (1) of Law no. 292/2018, introducing a new paragraph (8) in Article 56 ind.1 of Government Emergency Ordinance no. 57/2007. This new provision specifically addresses protected natural areas of national interest, excluding those classified as community interest, such as 'Natura 2000' sites.
Additionally, Article II of the law simplifies the requirements for strategic projects designated by the Supreme Council of National Defense (CSAT), ensuring that national security needs are balanced with environmental protection. The Constitutional Court confirmed that this article aligns with the constitutional provisions, thereby paving the way for future developments in Romania's energy sector.
